Change Nebraska Workers’ Compensation Act provisions governing disability compensation after retirement.

Description:

LB 963 would reduce the cost of providing workers’ compensation coverage for injured employees, in particular, those employees who are “retired.” Compensation benefits for total and partial disabilities would be reduced by an amount equal to fifty percent of the federal social security retirement benefits received by retired employees.

Retirement would be established by a preponderance of the evidence supporting a conclusion that an employee has retired, with receipt by an employee of social security retirement benefits or receipt of any other military service based government retirement pension, but not including a disability based government pension, establishing a presumption of retirement. Such presumption is rebuttable by a preponderance of the evidence.

A reduction of benefits under LB 963 would not apply to an injury sustained prior to the employee reaching 55 years of age and more than five years prior to his or her date of retirement. The bill would not provide for an offset against payment of medical bills or benefits associated with single member scheduled injuries.
