Change provisions relating to the Department of Health and Human Services. (Health and Human Services Committee priority bill)

Description:

LB 849 provides the following technical changes in the area of health and human services.
· Updates the state law regarding references to the Federal Social Security Act in State Medicaid statutes so any federal changes can be incorporated by reference (Section 1).
· Deletes obsolete trafficking and legal penalties language to the Supplemental Nutrition Assistance Program (SNAP) statutes (Sections 2, 3 and 4).
· Deletes obsolete language relating to the continuous process used in the reporting of past due child support for the State Tax Refund offset process (Section 5).
· Changes developmentally disabled specialized services by deleting the requirement to have elected officials on their governing boards. Also, this bill changes the governing boards membership provisions (Section 6).
· Changes the decision-making authority to the Director of Developmental Disabilities instead of the hearing officer (Sections 7 and 8).

Passed by the Legislature, 43-0-6, on April 8, 2010. Approved by the Govenor April 13, 2010.
