LR289CA

Constitutional amendment to prohibit laws that restrict or interfere with choice of health care plans or direct payment for medical services.

Description:

If passed by the Nebraska Legislature and approved by voters in the November 2010 election, LR289CA would add the following to the state constitution:

Because all people should have the right to make decisions about their health care, no law shall be passed that:

(1) Restricts a person's freedom of choice of private health care systems or private health plans of any type;

(2) Interferes with a person's or an entity's right to pay directly for lawful medical services; or

(3) Imposes a penalty or fine of any type for choosing to obtain or decline health care coverage or for participation in any particular health care system or health plan.

Statement of intent: LR289CA would add a new section 31 to Article I of the Constitution of the State of Nebraska. The legislation would not allow a law to be passed in the state of Nebraska that restricts a person’s choice of health care systems, private health plan, or interfere with a person’s right to pay directly for legal, medical services. It would prohibit a penalty or fine of any type from being imposed for choosing or declining health care coverage, or participating in any particular health care plan or system.
