Change diversity criteria under the Student Diversity Scholarship Program Act (Priority Bill of Speaker Flood of Norfolk Dist. #19)

LB440 was introduced in light of the 2008 adoption of Initiative 424 which changed Nebraska's Constitution on discrimination; basically prohibiting affirmative action. Because of the text of the passed initiative, there was concern that the current language of the Student Diversity Scholarship Act might not be consistent with the Constitution. LB440 strikes references to racial, ethnic and cultural diversity. It maintains a commitment to diversity, but provides that related efforts are to be undertaken "in accordance with state and federal law." The bill passed 44-0-5. |
