LB420

Change a sales tax exemption relating to nonprofit organizations.

Description:

Health care clinics owned by a single nonprofit hospital would be exempt from sales and use taxes.  Currently, state law requires that a clinic be owned by two or more hospitals or parent corporations to be eligible for the exemption.  Health care clinics owned by one nonprofit hospital were once exempt, but were notified by the State Dept. of Revenue that they now are subject to sales tax.  There is only one clinic in Nebraska that is owned by two or more nonprofit hospitals.  The bill initially passed 44-5 with the Emergency Clause (meaning the bill would take affect immediately open gubernatorial approval), but Sen. Hadley filed a successful motion to request that the Governor return the bill.  It returned to Final Reading.  CARRYOVER TO THE 2010 LEGISLATIVE SESSION

Passed the Legislature, 42-3-4, on April 12, 2010. Vetoed by the Governor April 12, 2010.
